The signing of the administrative offense report is not sufficient evidence to confirm the existence of an administrative offense

The Court of Cassation of the Republic of Armenia, in the judicial act VD/6527/05/18, addressed the legal question of whether the signing of the administrative offense report in the presence of the person who allegedly committed the offense, and without any objection from that person, can be considered sufficient evidence to confirm the existence of an administrative offense.

Reaffirming its previously expressed legal positions, the Court of Cassation stated that although the administrative offense report is an independent type of evidence, it is still subject to evaluation in the context of the combination and sufficiency of the evidence necessary to establish the fact of the existence of an administrative offense.

In such circumstances, the Court of Cassation noted that the administrative offense report alone, which has been signed by the person who allegedly committed the offense without any objection being raised, is not a sufficient basis to consider the fact of the administrative offense established.
