Conditions for Providing State Support to Families Paying Off Mortgage Loans Due to Childbirth

One of the components of the state support program for housing security of families with children is the state support for families paying off mortgage loans due to childbirth (hereinafter referred to as support).
According to the law, the parent who is a borrower under the mortgage agreement and is a citizen of the Republic of Armenia, and who owns the residential property acquired or constructed (built) with a mortgage loan (hereinafter referred to as the Beneficiary), has the right to receive a one-time support in the amount specified by the legislation.
The parent is considered a beneficiary if both the parent and the child (children) are identified based on the data from the state population register. It is noteworthy that the identification of the parent with a child born in a foreign country is carried out not through the child's birth certificate, but through the passport issued to the child as a citizen of the Republic of Armenia. In other words, a child born in a foreign country must have a passport of the Republic of Armenia, which is equivalent to Armenian citizenship.
Support for mortgage repayment is provided if:
1) the beneficiary applies to be included in the program before the child turns 1 year old,
2) the price of acquiring the residential property or the estimated market price of the acquired property or the constructed (in the presence of a completion act) property, or the estimated price of the property under construction (in the case of a construction loan) does not exceed 35 million drams, which is increased by 5 million drams for each of the beneficiary's 3rd and subsequent children. Moreover, if there are multiple estimated market values at the time of application, the maximum of these values is considered, and if the beneficiary has changed the organization that provided the mortgage loan after acquiring the property, the estimated market price is determined based on the evaluation results conducted within the framework of the loan transfer.
3) as of the date of application, the beneficiary must have a mortgage loan obligation taken at least one year ago, and the total number of delayed days for the mortgage loan repaid in the last year (12 months) should not exceed 30 calendar days.
4) the residential property acquired or constructed/built with the mortgage obligation must be the only residential property owned by the beneficiary (and, in the case of registered marriage, also by their spouse) under personal or joint ownership or common shared ownership (with a share of 50 percent or more) or the right to purchase:
If any of the specified requirements are not met, the competent authority rejects the provision of support.
In cases where the competent authority rejects the provision of support on the grounds of non-compliance with the legislative requirements, the applicant has the right to appeal this decision in the administrative court.
It should be noted that if the beneficiary has received one-time support and subsequently sold the apartment during the term of the mortgage loan, they are obliged to return the state support amount to the state.
