On September 24, 2019, the Constitutional Court of the Republic of Armenia made a decision in favor of the application submitted by lawyer Aram Khachatryan from the Ailex law office:
The respondent in the case was the legal support department of the legal expertise division of the National Assembly's staff:
Aram Khachatryan represented our client Sevak Haji Hakobyan, whose rights to judicial defense had been unjustly restricted by the courts of the Republic of Armenia:
The Court of Appeal of the Republic of Armenia applied the law in a manner that violated the right to a fair trial as provided by the Constitution. The Supreme Court did not examine the case at all, returning it to the plaintiff:
The Constitutional Court of the Republic of Armenia once again confirmed that when applying to the court, a person should not be burdened with unnecessary formal requirements, and legislative regulation should not create a socially disproportionate burden on individuals based on their financial capabilities, ultimately failing to ensure the right to access to the court... and so on:
As a result, it was decided that the final judicial act issued is subject to review based on new circumstances in accordance with the law, as the articles of the Civil Procedure Code were applied to the applicant with an interpretation differing from the constitutional legal content specified in the decision.
