It is now possible to restrict a citizen's right to exit from the territory of Armenia based on a non-monetary claim, or as it is said, the S.E.C.T. (State Electronic Information System of the Republic of Armenia) can be closed.
It should be noted that this does not refer to the restriction of the right to exit based on monetary claims (fortunately, this does not exist in Armenia yet, while it has been in effect in Russia for a long time).
Based on a judicial act that imposes a ban on the exit of a wanted person from the territory of the Republic of Armenia, the enforcement officer restricts the exit right of the wanted person from the territory of the Republic of Armenia by their decision:
The first instance general jurisdiction (civil) court at the location of the relevant service division makes a decision on the restriction of the exit right of the debtor wanted from the territory of the Republic of Armenia based on the application of the enforcement officer, if the act subject to enforcement that imposes a non-monetary claim cannot be executed without the personal participation of the wanted person, and all legally permissible measures taken by the enforcement officer to locate them have been unsuccessful.
The court examines the enforcement officer's application and makes a decision without convening a court session, based on the materials submitted with the application, within ten days after receiving the application. The court's decision can be appealed, but the execution of the decision cannot be suspended by the appellate court's judicial act.
The restriction of the exit right of the debtor wanted from the territory of the Republic of Armenia is lifted by the enforcement officer's decision immediately after the termination of the wanted status or the annulment of the court decision on the restriction of the exit right, but no later than within 24 hours:
The enforcement officer enters the necessary data on the restriction and lifting of the exit right of the debtor wanted from the territory of the Republic of Armenia into the border electronic management information system immediately, but no later than within 24 hours, in accordance with the procedure established by the Government.
