Amendments and additions have been made to the RA Code of Administrative Offenses. From now on, the decision on the fine imposed by the Traffic Police for violating the rules must first be appealed to a higher administrative body, and only then to the court:
The 287th article of the Code has been rephrased as follows.
The decision made by the body conducting the proceedings on the administrative offense can be appealed (challenged) in the administrative manner established by this Code or in the judicial manner established by the Administrative Procedure Code of the Republic of Armenia, except for the cases provided for in part 2 of this article. An administrative act cannot be appealed (challenged) in the administrative manner if the same administrative act has been contested in the judicial manner, and if the complaint (appeal) against the administrative act has been accepted for judicial proceedings before the contestation of the administrative act, then in that case, the proceedings initiated by the administrative body are subject to termination:
2. The administrative acts established by articles 123, 123.1, 123.3, 123.4, 123.5 (except for the violations provided for in parts 8, 9, 14, and 15), 123.6, 123.7, 124-124.4, 124.6, 125, 126, 128, 129.2, 131, 132, 135.2, and 140 can only be contested in court after being appealed (challenged) in the administrative manner:
3. The decision is appealed (challenged) in the administrative manner to the administrative body that adopted the administrative act, the higher administrative body, or in cases provided by law, to another competent administrative body:
If the decision regarding the administrative offense has been sent by email in accordance with article 283 of this Code, then that decision can also be appealed via the same email, with an electronic notification of receipt of the appeal:
SECTION 2. The second part of article 291 of the Code is supplemented with the following content.
"2. In the cases provided for in part 2 of article 287 of this Code, the appeals against the decision regarding the administrative offense are examined within a fifteen-day period from the date of their receipt."
The amendment and addition have come into force since November 30, 2019.
