In certain cases, disputes over confiscation of money will be examined by notaries

RA Law "On Notary" dated 07.02.24. with the amendments made, notaries have been given the authority to examine some disputes about the confiscation of money, which is aimed at relieving the burden on the courts. Applicants can submit an application for issuing an order demanding the confiscation of money not to the preferred notary, but to the notary chamber, which is authorized to distribute cases between notaries through the electronic system.
Can anyone file an application for a foreclosure order with the notary?
Only banks, credit organizations, as well as utility service providers, such as electricity, heat supply, gas supply, water and telecommunications, including electronic communications, based on contracts concluded with consumers or customers, can submit an application to the Notary Chamber. provided that the amount subject to confiscation does not exceed two million AMD (including damages, interest and other fees) as of the date of filing the application. In case of submitting a demand for confiscation in foreign currency, the issue of compliance of the demand with the mentioned criterion is determined by the average exchange rate of the Armenian dram in foreign currency markets as of the date of submitting the application, published by the Central Bank.
How much is the notary fee?
Resolution N 1584 of the Government of the Republic of Armenia defines the minimum and maximum amount of the notary fee charged for issuing an order with a demand for confiscation of money: from 5,000 to 10,000 AMD.

The terms and procedure for consideration of the application for issuing an order with the demand for confiscation of money are defined by the law.
