If you and your spouse decide to get a divorce and you have a minor child, then you will have to make decisions regarding where and with whom the minor will live with. If you believe that the out-of-court methods will not work at your case then you can lodge a claim at the court straight away. "What is in the child's best interests?" are of chief concern to the judge making the custody decision.
Considering the custody arrangements, the judge notes all of the arguments presented by both sides. Every aspect of an individual’s life may be scrutinized in a child custody case. There is not a single factor that decides a custody case. The importance of a particular factor may vary with each case and some of the most common factors include:

• The reasonable preference of the child if they are of sufficient age to express preference,
• Needs of the children, and the health condition of both parents,
• The quality of life, while living with one parent or the other,
• The emotional bond between each parent and child,
• The ability of the parent to provide a safe home environment,
• Any history of mental illness, substance abuse, child abuse or neglect in either or both prentices,
• The moral characters of the parents, and the financial status of each parent.

A child under age of 10 can express his/her opinion about the matter, which should be considered among other circumstances. A child reaches the age of 10 legally allowed to choose which parent to live with. Anyway, if the judge finds that the child’s wish is contrary to his/her best interests, then that opinion cannot be taken into account at the decision making process.
The best interest of the child is the primary consideration in any custody dispute and will prevail over the rights of either parent.
